Short answer
PPWR product rules apply. For EPR you stay in UK pEPR. NI to Republic of Ireland is a sale into the EU.
What applies in NI
- PPWR product rules, via the Windsor Framework: recyclability, single-use restrictions, and eventually harmonised labelling.
What does not
- PPWR packaging EPR and deposit return schemes.
- NI remains inside the UK pEPR scheme with Great Britain.
The cross-border catch
- An NI to Republic of Ireland sale is a sale into the EU market.
- Irish EPR logic applies to it — Repak is the starting point.
- You can be inside UK pEPR and an EU scheme at the same time, for different sales.
The open question
- Whether Article 45(3) requires an NI seller to appoint an authorised representative is unsettled.
- The proposed suspension was drafted for EU-established producers and excluded third-country producers.
- Council negotiations on that proposal were discontinued on 24 June 2026.
- An NI business is not EU-established. Get this confirmed in writing by the national register or a compliance provider.
