Short answer

PPWR product rules apply. For EPR you stay in UK pEPR. NI to Republic of Ireland is a sale into the EU.

What applies in NI

  • PPWR product rules, via the Windsor Framework: recyclability, single-use restrictions, and eventually harmonised labelling.

What does not

  • PPWR packaging EPR and deposit return schemes.
  • NI remains inside the UK pEPR scheme with Great Britain.

The cross-border catch

  • An NI to Republic of Ireland sale is a sale into the EU market.
  • Irish EPR logic applies to it — Repak is the starting point.
  • You can be inside UK pEPR and an EU scheme at the same time, for different sales.

The open question

  • Whether Article 45(3) requires an NI seller to appoint an authorised representative is unsettled.
  • The proposed suspension was drafted for EU-established producers and excluded third-country producers.
  • Council negotiations on that proposal were discontinued on 24 June 2026.
